hereinafter referred to as the provider, the contract is concluded.
Subject matter of the contract
This contract regulates the sale of online services for small businesses in the area of website creation or modification, company pages in social media
creation, imprint and data protection (according to the new EU-DSGVO) creation via the website of the provider. For details of the respective offer,
please refer to the product description on the offer page.
Conclusion of contract
The contract is concluded in electronic business transactions via the website of the provider or via other means of remote communication such as
telephone and e-mail. In this context, the offers presented represent a non-binding invitation to submit an offer through the customer's order,
which the provider can then accept. Orders can also be placed via means of distance communication (mobile/email), whereby the ordering process for the
conclusion of the contract includes the following steps:
º Calling the order hotline / sending the order e-mail
º confirmation e-mail that the order has been received.
The contract is concluded with the sending of an order confirmation. The order confirmation created and sent does not constitute a corresponding
legally binding declaration. The contract is also concluded by sending the goods or providing the service.
Contract duration
The contract is subject to a term of 1 to 30 days per order and agreement. The total price is calculated from the following components: according
to my offer page or depending on the scope on individual agreement.
Reservations
The provider reserves the right not to provide the promised service in the event of unavailability (e.g. internet malfunction, illness) upon repayment.
Prices, shipping costs, return costs
All prices do not include sales tax (value added tax), which is still due in addition. If a right of revocation exists and is exercised, the customer shall bear the
costs of the return shipment.
Terms of payment
The customer has exclusively the following options for payment: immediate bank transfer and invoice upon delivery. Other payment methods are not
offered and will be rejected.
The invoice amount is to be transferred to the account stated on the invoice after receipt of the invoice, which contains all details for the
transfer and is sent with the delivery. The customer is obliged to pay or transfer the amount shown on the invoice to the account stated on the
invoice within 14 days of receipt of the invoice. Payment is due without deduction from the date of the invoice. After expiry of the payment
deadline, which is thus determined by calendar, the customer shall be in default even without a reminder. Offsetting against claims of the
customer is excluded unless these are undisputed or legally established.
Terms of delivery
The goods will be dispatched immediately after confirmed receipt of payment and prior agreement. The entrepreneur undertakes to deliver within 30 days
after receipt of order. The standard delivery time is between 1 and 30 days, unless otherwise stated in the item description. The supplier ships the
order as soon as the entire service has been created. The customer will be informed immediately of any delays. If the provider is not responsible for a
permanent obstacle to delivery, in particular force majeure or illness, although a corresponding covering transaction was made in good time, the
provider has the right to withdraw from a contract with the customer in this respect. The customer shall be informed of this immediately and any
services received, in particular payments, shall be refunded.
Warranty
The supplier is granted the right to choose between correction or new delivery in the event of subsequent performance if the goods are new and
the customer is an entrepreneur. This does not apply to claims for damages of the customer due to injury to life, body, health or essential
contractual obligations which must necessarily be fulfilled in order to achieve the objective of the contract. Likewise, this does not apply to
claims for damages following grossly negligent or intentional breach of duty by the provider or his legal representative or vicarious agent. In
all other respects, the statutory provisions shall apply.
Contract design
The contract text is stored by the supplier. The customer has the following option to access the stored contract text: The customer receives the
contract for signing by e-mail. After signing the contract, the customer must return it to the provider by e-mail. The customer can correct
errors in the order process. This requires an e-mail with detailed changes to the ordered service to the provider.
Right of withdrawal and customer service
The regulations for distance contracts do not apply to customers who are entrepreneurs. Therefore, these customers do not have a corresponding
right of withdrawal due to a distance contract. The supplier does not grant such a right either.
